These terms and conditions outline the rules and regulations for the use of RightOne, Inc.'s website and web app, located at https://talentwell.ai and https://app.talentwell.ai, respectively.

By accessing this website and/or using our web app, we assume you accept these terms and conditions. Do not continue to use TalentWell if you do not agree to take all of the terms and conditions stated on this page.

Cookies: The website and web app use cookies to help personalize your online experience. By accessing TalentWell, you agreed to use the required cookies.

  • Sell, rent, or sub-license material from TalentWell

  • Reproduce, duplicate or copy material from TalentWell

  • Redistribute content from TalentWell

This Agreement shall begin on the date hereof.

Payment Terms

All payments for our services are processed by Stripe. We accept major credit cards and other payment methods supported by Stripe. By providing your payment information, you authorize us to charge the applicable fees to your payment method. Subscription renewals will be automatically charged to your payment method unless you cancel your subscription in accordance with our cancellation policy.

Renewals, Cancellations, and Refunds

Subscriptions to TalentWell services renew automatically at the end of each subscription period unless canceled by the user. By providing your payment information and subscribing to our services, you authorize us to automatically charge the applicable subscription fees to your payment method at the start of each renewal period.

If you wish to cancel your subscription, you must do so before the renewal date to avoid being charged for the next subscription period. Cancellations can be made through the account settings in the app. Upon cancelation, your subscription will remain active until the end of the current subscription period, after which it will not be renewed.

We do not offer refunds for any subscriptions. Once a subscription period begins, the fees are non-refundable, and the service will remain active until the end of the current period. It is the user's responsibility to manage and cancel subscriptions timely to avoid unwanted charges.

User-Generated Content: Parts of this website and web app offer users an opportunity to post and exchange opinions and information in certain areas of the website. RightOne, Inc. does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of RightOne, Inc., its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, RightOne, Inc. shall not be liable for the Comments or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

RightOne, Inc. reserves the right to monitor all Comments and remove any Comments that can be considered inappropriate, offensive, or causes breach of these Terms and Conditions.

You warrant and represent that:

  • You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;

  • The Comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party;

  • The Comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material, which is an invasion of privacy;

You hereby grant RightOne, Inc. a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.

Avatar Creation and Usage

Avatar Creation: By using TalentWell's avatar creation feature, you (the "User") agree to upload a video of yourself for the purpose of generating a personalized avatar. You confirm that you have the necessary rights, permissions, and consents to use and upload this video, including all rights related to your voice, image, and likeness. By uploading the video, you authorize TalentWell and its service providers to use this content solely for creating the avatar.

Retention and Use of Content: TalentWell will retain the uploaded video and the generated avatar. The video and avatar may be used within the TalentWell platform to enhance your user experience, including but not limited to communication with candidates or other users. You acknowledge that the video and avatar content will not be used for any purposes outside of those stated in this agreement.

User Responsibilities: You agree not to upload any content that is illegal, fraudulent, harmful, or that violates the rights of any third party. Any violation of these terms may result in the suspension or termination of your account and may lead to legal action.

Third-Party Services: TalentWell collaborates with third-party providers to create your personalized avatar. By using this service, you agree to the involvement of these third-party providers in the avatar creation process. TalentWell is not responsible for any actions or omissions of these third parties, except as required by law.

Hyperlinking to our Content: The following organizations may link to our Website without prior written approval:

  • Government agencies;

  • Search engines;

  • News organizations;

  • Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and

  • System-wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.

These organizations may link to our home page, to publications, or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.

We may consider and approve other link requests from the following types of organizations:

  • By use of our corporate name; or

No use of RightOne, Inc.'s logo or other artwork will be allowed for linking absent a trademark license agreement.

Content Liability: We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that are raised on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene, or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
